MAJOR ACTION TAKEN BY NHDES AGAINST BIO ENERGY PERMIT
Attached you will find a copy of the notice filed this day by the New Hampshire Department of Environmental Services, Waste Division, advising Regenisis of its intent to revoke Bio Energy's solid waste permit to burn C&D. This is based on NHDES' determination that Bio Energy and its permit holder, Regenesis Corporation, violated its permit in the following ways:
1. failed to advise DES that one of its principals was convicted of a felony
2. failed to advise DES that Bio Energy Corp underwent dissolution
3. failed to advise abutters of a public hearing regarding its intent to modify its Title V permit.
4. failed to give accurate and complete information in its application for a waste permit in that its President, "William Dell'Orfano made a false or misleading statement when he certified that none of Bio Energy's officers or directors had been convicted of a felony in the five years prior to the application for permit transfer.
5. failed to demonstrate sufficient reliability, expertise, integrity, and competence to operate a solid waste facility.
As a consequence of these violations, NHDES has ordered Regenesis to show cause why its permit should not be revoked or the permit reopened. Regenesis has the right to a hearing to contest these allegations at a hearing scheduled for January 7, 2005 beginning at 10:30 am in Room C-112/113 of the DES offices at 29 Hazen Drive in Concord, NH.
